Compétence De La Ccja - Action En Réparation Du Préjudice Résultant De La Nullité D'une Saisie-vente - Affaire N'ayant Donné Lieu à L'application D'aucun Texte De L'ohada - Incompétence De La Ccja
La CCJA est incompétente pour un litige portant sur la réparation du préjudice découlant de la nullité de la saisie-vente. Une telle action est exclusivement fondée sur les dispositions du droit interne, la violation alléguée, pour la première fois en cassation, de l'article 144 de l'AUPSRVE indique clairement qu'une telle action en responsabilité est exercée dans les termes du droit commun ; d'autant plus que les premiers juges ne se sont prononcés sur ledit litige qu'en application stricte des dispositions relevant du droit national.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
