Report on the OHADA Session held November 16, 2011, as part of the Legal, Justice and Development (LJD) Week 2011 at the World Bank headquarters in Washington DC

LJD Week 2011 is a World Bank Group's event, held at the World Bank's Washington DC headquarters November 14 - 17, 2011, and co-organized by the World Bank's Legal Vice Presidency, the IFC and MIGA Legal Departments, and the ICSID. This event explored in parallel sessions over four days how legal innovation and empowerment contribute to development. A session devoted to the OHADA, titled >“Legal Harmonization as a Tool for Regional Integration-The OHADA's Experience”, was held on Wednesday 16, 2011 from 9:30 am to 12:45 pm.
The session was composed of highly distinguished speakers. In addition to the staff of the Bank Group and the IFC, LJD Week brought together a number of senior officials, including Mr. N'dongo Fall, Vice-President of the OHADA Common Court of Justice and Arbitration (CCJA), Mr. José Angelo Estrella Faria, Secretary General, UNIDROIT, and Mr. Kalidou Gadio, General Counsel of the African Development Bank, and two experienced OHADA lawyers, Mr. Renaud Beauchard (Law Offices of Peter C. Hansen) and Mr. Marc Frilet (Partner at Frilet Société d'Avocat-Paris). Among others representing the World Bank was Mr. Gilberto de Barros, Senior Private Sector Development Specialist, Africa Region, World Bank, and representing the IFC was Mr. Xavier Forneris.
The discussion focused on OHADA's various accomplishments and challenges, and focused on an evaluation of the role of the Uniform Acts in supporting economic development. The value of the Uniform Acts' modernization of local law, issues concerning their implementation and effectiveness, as well as the extension of OHADA to non-Francophone countries, were also addressed. Finally, Mr. Xavier Forneris and Mr. Gilberto de Barros presented in detail, their respective institutions' contributions to the OHADA modernization and harmonization process from inception to-date, and described projected efforts to address the continuing challenges.

The Foundation for the Unified Business Law in Africa (F.U.B.L.A) represented by Prof. Claire Moore Dickerson and Dr. Jean Alain Penda participated in the discussion. They made available to the participant of the session an OHADA informative booklet in English.
This initiative from the World Bank Group to discuss OHADA and its way forward was highly appreciated and we hope there will be many more occasions like this one to get vocal about OHADA.
