Launching of the training session on the “Practice of simplified debt recovery procedures and enforcement measures” in OHADA Space

The multi-purpose hall of the Higher Regional School of Magistracy (ERSUMA), located in Porto-Novo, the capital city of the Republic of Benin, is, since this morning, hosting a training session on “the practice of simplified debt recovery procedures and enforcement measures” in the OHADA space.
This training session which has been requested and financed by the Bailiffs of the Chamber of Brazzaville in the Republic of Congo, brings together 25 participants. In addition to the 22 Congolese Bailiffs, ERSUMA, in line with its policy of integration and inter professional cooperation, invited 3 additional Bailiffs from the Republic of Benin so that they may interact with their peers from Congo.
For five days, participants will revisit the fundamentals of the Uniform Act on simplified debt recovery procedures and enforcement measures, the various types, the conditions, the effects and incidents relating to the simplified debt recovery procedures and enforcement measures. The training session will focus on identifying difficulties in applying the UA, seeking solutions and, where appropriate, proposing guidelines for improving the system in order to achieve the objectives of OHADA. Thus, the opposition to injunction order, execution measures in the event of insolvency proceedings, the impact of forfeiting agreement on enforcement procedures, the practice of provisional seizures, other seizures of movable property and attachments of immovable property will be discussed.
The training session will be marked by practical presentations, sharing of experiences and workshops for a better understanding of professional issues arising in the practice of bailiffs; There will also be case law illustrations from national courts and the CCJA as well as issues to take into account in the implementation of the Uniform Act on simplified debt recovery procedures and enforcement measures.
The opening ceremony had two speeches. Mr Ange-Anicet MATONDO GOMA, President of the Chamber of Bailiffs opened the floor, thanking the authorities of ERSUMA for their warm welcome and diligence in organizing the session and reminding them of their expectations. He was followed by Prof. Mayatta Ndiaye MBAYE, Director General of ERSUMA, who gave a welcome speech and opened the training session. In his address, he made a presentation of ERSUMA and reiterated that the mandate of the Institution is not only limited to training and capacity-building of magistrates, judicial officers and other legal professionals, but also covers research, documentation, consultation in OHADA Business Law and other African community laws.
