The Regional Advanced School of Magistracy (ERSUMA) of the Organisation for the Harmonisation of Business Law in Africa (OHADA), in partnership with the OHADA National Commission (CNO) of Chad, the Vocational Training Centre for Ports and Digitisation of Businesses Members of the Association for the Management of Ports in West and Central Africa (CFP-AGPAOC), with the support of the OHADA Law Promotion Centre in Chad (CADOT) and the N'Djaména Arbitration, Mediation and Conciliation Centre (CAMC-N), is organising a bimodal training session from 21 to 23 October 2024. This session will be held simultaneously in person at Hôtel de l'Amitié (Ledger Plaza Hôtel/former Kempinski) in N'Djaména (Chad) and by Videoconference on the theme: “Practice and litigation of multimodal freight transport contracts”.
Multimodal freight transport is the organisation of the movement of goods combining several modes of locomotion subject to different legal regimes, on the basis of a transport document and under the responsibility of an operator known as a multimodal transport contractor (MTC). However, the absence of specific regulations for this mode of transport compels professionals to combine the legal regimes of the various unimodal treaties, which can cause difficulties in determining the rule applicable to liability, legal action, time limits and other compensation. The effective management of transport contracts in this area is therefore of vital importance in view of the exponential growth in international trade. Logistics professionals, in-house lawyers and specialised lawyers need to know the ins and outs of this complex legal framework in order to mitigate risks and resolve potential disputes effectively. By learning the ropes on specific contractual clauses and international regulations, participants will be able to improve the management of their transport operations, strengthen their legal compliance and optimise their relations with their trading partners. As the need to strengthen specialised skills has proved crucial, this course aims to provide participants with an in-depth understanding of multimodal freight transport law, covering both its practical and litigation aspects.
