1. Si le décret 95-637 du 23 Août 1995 crée une obligation de constituer caution à la charge des exportateurs de café-cacao, il n'en précise pas les formes qui demeurent soumises à l'Acte uniforme sur les sûretés.
2. Les actes de cautionnement critiqués ayant été établis les 6 octobre et 18 novembre 1998, ils sont soumis à l'Acte uniforme sur les sûretés entré en application le 1er janvier 1998 (article 150 AUS).
3. Le débiteur garanti, bien que tiers au contrat de cautionnement a intérêt pour agir en nullité contre cette convention.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
