Un bailleur reproche au preneur de n'avoir payé que partiellement les loyers échus. En première instance, il obtient l'expulsion du preneur sur le fondement de l'article I0I AUDCG et sa condamnation à lui payer les sommes réclamées en complément.
Or le montant du loyer stipulé au bail est exactement égal au paiement dont le preneur s'est régulièrement acquitté. La Cour d'appel a jugé que seules ces stipulations tiennent lieu de loi des parties au sens de l'article 1134 C. civ. En conséquence, le jugement condamnant et expulsant le preneur qui payait régulièrement son loyer ne fait pas application de l'article I0I AUDCG et ne peut être qu'infirmé.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
