Lorsqu'il ressort du rapport de l'expert désigné que le redressement de l'entreprise en règlement préventif s'avère impossible parce qu'elle se trouve en état de cessation de paiements, la juridiction compétente prononce sa mise en liquidation des biens, nomme les organes chargés de conduire cette liquidation (syndic et juge commissaire) et ordonne l'apposition des scellés ainsi que la publicité du jugement.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
