Droit Commercial General - Bail Commercial - Sous-location - Expulsion Par Voie D'ordonnance (non) - Resiliation - Juridiction Competente - Article 101 Audcg
Un immeuble a été sous-loué par un locataire pour une durée de deux ans renouvelables. Six mois plus tard, le sous-locataire est expulsé en vertu d'une ordonnance à pied de requête. C'est l'infirmation de cette ordonnance que demande l'appelant. Selon la cour d'appel, un bail commercial ne peut être résilié ni par une ordonnance de référé, ni par une ordonnance à pied de requête. Le contrat de sous-location entre les parties étant un bail commercial, sa résiliation ne peut être prononcée que par un jugement selon les termes de l'article 101 de l'AUDCG. Doit en conséquence être infirmée, l'ordonnance à pied de requête ayant prononcé la résiliation d'un tel bail et l'expulsion du sous locataire.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
