L'irrecevabilité étant la conséquence de la déchéance, en statuant comme il l'a fait le 1er juge a fait une bonne application de la loi. En effet, il ressort des pièces du dossier que le recours en opposition n'a pas été signifié au greffe de la juridiction ayant rendu la décision d'injonction de payer en violation des prescriptions de l'article 11, alinéa 1er de l'AUPSRVE qui fait obligation à l'opposant, à peine de déchéance, de signifier son recours non seulement aux parties mais aussi au greffe de la juridiction qui a rendu la décision d'injonction de payer.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
