La preuve de l'existence de la créance ayant été rapportée par témoins, les ayants droit du propriétaire de l'entreprise doivent être condamnés à payer au créancier poursuivant la dette de l'entreprise.
Il en est ainsi lorsqu'il a existé entre le créancier et le débiteur défunt des relations commerciales fondées sur des usages et des habitudes comme définis aux articles 5, 207 alinéa 1 et 208 de l'AUDCG.

On 10 April 2025, a strategic meeting was held in Abidjan between OHADA and the Financial Markets Authority of the West African Monetary Union (AMF-UMOA).
