Publication by the publishing house MINSI LE COMPETING of a new textbook on OHADA: "Droit pénal des affaires OHADA" (The OHADA Criminal Law of Business)

It is with pleasure that we announce a new publication on OHADA: "Droit pénal des affaires OHADA", presented by the Cameroonian publisher, MINSI LE COMPETING. As the title suggests, this new text studies criminal law aspect of OHADA's business laws. The author of the textbook, Mr. Roger SOKENG, has earned his Ph.D. in Private Law, is a magistrate, and a Senior Law Lecturer at several Cameroonian universities. He also is Secretary of the "Revue Camerounaise de l'Arbitrage" (The Cameroonian Arbitration Journal). He is currently the President of the Court of First Instance in Nkongsamba (Littoral, CAMEROON). The concept of this textbook is to gather in a single document both the provisions concerning penal law that appear throughout the OHADA Uniform Acts, and certain related provisions from the non-OHADA domestic laws of the OHADA treaty's State-parties. By this analysis, the author gives legal practitioners ready access to criminal law tools that regulate those who engage in business or otherwise enter the economic markets, thus further implementing OHADA's contribution to a fair and efficient economic environment. In addition to these general principles, Part II of this textbook focuses on the different criminal orientations in the OHADA community. It examines the offences defined by the Uniform Act, using Cameroon and Senegal as specific illustrations. Consequently, the book includes in its appendices the following laws relevant to the OHADA criminal law of business:
  • Art 5 Paragraph 2 of the OHADA treaty
  • The Senegalese Law of the 26th March 1998
  • The Cameroonian Law of the 10th July 2003

    Je remercie énormément l'auteur pour cet ouvrage tant attendu dans la mesure où il vient combler le déficit dans cette branche répressive du droit des affaires de l'ohada. Je voudrais que l'on élargisse la vente jusqu'à Libreville au Gabon. Si c'est déjà fait où peut-on se le procurer? Encore merci à l'auteur.

    je pense que cet ouvrage est le bienvenu ; si on peut aussi le vendre au GABON pour que nous puissions aussi avoir des connaissances en droit pénal des affaires ohada c'est un cours qui me manque vraiment donc s'il vous élargissez la vente jusqu'à Libreville si c'est déjà fait où peut on se le procurer?

    Un bravo particulier à l'initiateur de cet ouvrage. En effet actuellement ce document nous permet, étudiants en droit des affaires d'approfondir nos connaissances en la matière ceci en se situant dans le contexte typiquement africain voir camerounais.
    Cependant il est à déplorer que comme beaucoup d'autres textes de loi il ne soit pas vraiment appliqué : on est reste attaché a la loi de 2003.

    Un droit pénal adapté au contexte OHADA évite non seulement les hésitations mais également les interprétations qui peuvent menacer la sécurité juridique. Félicitation donc à l'auteur de cet ouvrage qui, en tant que magistrat, a senti la nécessité de l'actualisation de cette discipline.

    Bienvenue à cet ouvrage. Je suis particulièrement pressé de l'avoir parce que l'arsenal juridique autour duquel s'est articulé le cours de droit pénal qui nous a été dispensé à la faculté nous paraissait très éparpillé. A la limite, j'ai eu l'impression que nous avions seulement bénéficié d'une tentative de transposition du droit pénal général au domaine des affaires et de l'activité économique, alors que cela ne semblait pas tout à fait adapté.
    Merci d'avance pour la disponibilité prochaine de l'ouvrage à Dakar et un grand bravo à l'auteur, mais aussi à tous ceux qui l'ont soutenu.
