Telecoms Legal and Regulatory Reform

We had kept you informed of the Article 59 of the Final Declaration of the latest Francophonie Summit in Ouagadougou (November 26-27,2004) mandating HE President Abdou DIOUF, OIF General Secretary, to investigate how to modernize the telecoms legal and regulatory environment. To update you about this very important matter, it is our pleasure to inform you that the not-for-profit Organization, Digital ACP (ACP Numérique), has produced a Memorandum in English and a Memorandum in French laying down some suggestions as to the principles, modalities and time frame of what could be the upcoming telecoms legal and regulatory reform. These documents are a contribution to encourage the thought process toward the implementation of the reform. All of us, supporters of the OHADA business law unification process, can only be satisfied and keep encouraging the implementation of a reform which could lead to the establishment by the states of a regional telecoms legal and regulatory framework. It is widely acknowledged that ICTs are a historically powerful opportunity to drive economic growth; the implementation of this legal and regulatory reform will be essential to the promotion of large scale investments in telecoms infrastructures (IP connectivity) and will prove an essential contribution to the reduction of the digital divide and to economic growth. It is our sincere wish that this reform will be actively carried forward and will enjoy a very strong support from the donors' community leading to its entire success.
