OHADA Nigeria CLUB

We have on behalf of Mr. AKIN AKINBOTE the honor and privilege to formally announce the birth of the OHADA Nigeria Club, registered as a company limited by guarantee under the Laws of the Federation of Nigeria by the Corporate Affairs Commission, on 27th day of June, 2007. The main objectives of OHADA Nigeria are as follows:
  1. To promote and develop the harmonization of laws in Africa and other parts of the world.
  2. To promote and develop uniform application and interpretation of laws in Africa and other parts of the world.
  3. To promote through harmonization of laws in Africa and other parts of the world the interests of commerce, trade, industry, banking, insurance, finance, transport, science, engineering, telecommunication, technology and all other related fields of human endeavor in Nigeria and other parts of the world.
  4. To promote and develop regional integration and economic growth in Africa and other parts of the world, through harmonization, uniform application and interpretation of laws.
  5. To promote and develop Rules of Arbitration, Mediation, Conciliation and other means of alternative dispute resolution in Africa and other parts of the world.
The inaugural meeting of the Club took place on 21st of August, 2007 and the following colleagues were elected officers of the Executive Committee to run its affairs.

All the members of the Executive Council are involved in one cross border practice or the other and International Commercial practice as Litigation Counsel, Arbitrators, Mediators, Jurists and Researchers. OHADA Nigeria's strategy is to move from theoretical application of OHADA Laws to practical application of the laws towards enhancing regional integration in all its ramifications and for the benefit of all in Africa, be it Francophone, Anglophone or Portuguese speaking. In this task, we realize that OHADA Laws are little known beyond the academic circles. This makes sensitization of the official, business, banking, legal, legislative circles very imperative and has to be carefully done. In pursuance of the above objectives, OHADA Nigeria has drawn out the following plan of action:
  1. "Prise de Contact" with ECOWAS Secretariat, ECOWAS States Ambassadors in Nigeria, ECOWAS Court, Federal Government Officials, Federal Legislators, Bankers, Businessmen, Lawyers and others who are involved or are interested in cross-border businesses.
  2. Formal courtesy visits to ECOWAS Secretariat, ECOWAS States Ambassadors in Nigeria, ECOWAS Court, Federal Government Officials, Federal Legislators, Bankers, Businessmen, Lawyers and others who are involved or are interested in cross-boarder businesses.
  3. Two Business Luncheons/Lectures (Abuja and Lagos) on OHADA, having as guests personalities in the identified sectors 1 and 2 above. Dr. ADESEGUN AKIN-OLUGBADE has consented to being a guest lecturer.
  4. Workshop and Seminars on OHADA in 2008.

    je loue cette initiative du Club OHADA Nigéria et j'ose espérer que les Clubs des autres Etats membres vont leur emboiter le pas. Car il faut dire que juste qu'à ce jour l"OHADA est méconnue du grand public et même des juristes des Etats membres. Je souhaite également qu'un accent particulier soit mis sur le bilinguisme (angiais/français) dans la zone OHADA. Moi même je suis francophone originaire de la Côte d'Ivoire et j'éprouve d'énormes difficultés à percevoir les messages anglais. Merci

    Le NIGERIA géant anglophone est un atout majeur et témoigne la preuve de l'unification de notre continent qui est en marche.l'environnement des affaires a besoin des gros bras. Donc continuons.

    Je salue l'intrêt organisé de juristes nigérians, praticiens et accadémiciens du droit, pour un élargissement de l'harmonisation et la sensibilisation ; cet effort devrait être appuyé dans un pays tel que le Nigeria par l'institution d'un véritable programme public (multilatéral) de soutien, qui renforce l'association dont la structure d'orientation vient d'être mise en place. Un succès éclatant dans les 5 ans sera un changement considérable dans le pays et la région.
    Dans le même temps, toute une partie de l'activité de cette association pourrait porter avantageusement sur la diffusion de ce type de groupement privé d'utilité publique, notamment dans nos pays de tradition francophone et colbertiste, où plus de la moitié de l'effort d'impulsion est demandé aux Etats et à leurs unions.

    Its a great news for us !

    It shows that OHADA is slowly but surely moving from a theorical application in anglophone african countries to a pratical one.

    Ceci est une avancée considérable dans le processus d'harmonisation du droit des affaires en Afrique, et particulièrement dans celui d'intégration des pays anglophones dans l'OHADA.
    En 2004, j'avais voulu écrire mon mémoire de maitre sur l'Applicabilité du droit OHADA dans les pays du système Common Law ( au choix le nigéria ou le ghana). Mais faute de documentation ou plutot d'informations , car ne pouvant voyager tout le temps et sans correspondant adéquat, j'ai par la suite abandonné apres vaines tentatives de joindre le Professeur YAKUBU.
    Donc félicitation au membres du club et leur dire que leurs taches seront multiples ( par exemple contacter un club d'un pays francophone comme le BENIN par exemple pour une collaboration fructueuse.

    This is the bomb and the lastest in town. I am glad having this information.

    The choice of personalities on the Executive Board is evidence of painstaking selection of Lawyers with outstanding integrity. There are so many seniors in this profession but some, their names call for standing ovation. They are role model in the profession.

    Well, I am a Lawyer by profession, just graduated from Nigerian Law school. It will be the most widely announced suicide if I do not grab this opportunity. I will like to be a registered Member of the Club.

    I owe it as a duty to forward the mail to my friends and give ten solid reasons of joining. Once again, thanks for this innovation, it is indeed, a privilege for the young lawyers.
