The Higher Regional School of Magistracy (ERSUMA) of the Organization for the Harmonization of Business Law in Africa hereby announces the publication of the 13th issue of ERSUMA Bulletin of Professional Practice (BEPP).
This periodical provides you with updates on business law, whether OHADA Law, Law of Member States, other African Community Laws and Comparative Law.
In this issue, reading the following sections including chronicles, Case Law, community legislations, you will have brief information on the followings topics:
- The supremacy of judgments of the Common Court of Justice and Arbitration (CCJA);
- Facilities for realizing the pledge of shareholders' rights and securities;
- The immunity from execution conferred on BCEAO applies not only to its own property and assets, but also to sums credited to the accounts opened in its books by the primary banks;
- The plant manager may not represent the public limited company in court without a special warrant;
- The claim resulting from closed current account agreements is certain, liquid and enforceable;
- The garnishee who fails to make any declaration during the seizure operation is in breach of his obligations as a garnishee and is liable to pay the sums for which the seizure was made;
- The lawyer's deed in the UEMOA area: between an authentic deed and a private deed.
The ERSUMA Bulletin is available in paper and digital format. It is on sale at ERSUMA Library and may be subscribed annually.
The paper format is available for sale at ERSUMA Library in Porto-Novo, the CCJA Documentation Centre in Abidjan, the Documentation Centre of OHADA Permanent Secretariat in Yaoundé, the OHADA National Commission of Senegal and with Me Hervé KANENE MAHINA, lawyer in Kinshasa (DRC, phone: +243 813 14 32 13) at 3,000 CFA francs ($6 USD) per unit. Other points of sale will be established in the States.
The annual subscription to the BEPP is 30,000 CFA francs ($60 USD), or twelve (12) issues per year.
