ERSUMA - OHADA / Publication of number 08 of the ERSUMA Review

afficheThe Regional High School of Magistracy (ERSUMA) of the Organization for the Harmonization of Business Law in Africa (OHADA) hereby notifies you the publication of No. 8 of the ERSUMA Review, a biannual review of African and comparative business law.

Published by its Research Centre, this review includes several contributions on current business law issues, including OHADA Law, National Law of the Member States, other African Community Laws and Comparative Law. Since the adoption of its new graphic charter, it has received contributions in French, English, Portuguese and Spanish and has been enriched, for each contribution, by a summary in French, English and Portuguese.

In this release, the reader will find more than ten scientific contributions set up around four (04) sections:

Doctrinal studies:

  • The judicial representative in OHADA Law of collective proceedings;
  • The sovereign power of the trial judge in the enforcement of the OHADA Uniform Acts: between appearance and reality;
  • The institutional nature of the company in the compensation scheme for corporate managers under OHADA Law;
  • Security concerns in the OHADA reform through the September 10th 2015 Collective Proceedings Act;
  • The domestication of Islamic finance in the CEMAC zone;
  • Mixed review after fifteen years of Regulation No. 01/02/CEMAC/UMAC/COBAC enforcement upon the requirements for practising and controlling of microfinance activity in CEMAC;
  • Some considerations on the flexibility of carrier's liability in OHBLA Law;
  • OHADA and financial Law;
  • The protection of workers' claims in the event of the insolvency of their employer: OHADA's approach;
  • The confirmation of a general theory of OHADA commercial contracts.

Legislations:

  • The balance between the parties in the December 21ST 2015 Act No. 2015/018 governing commercial activity in Cameroon.

Professional practice:

  • The conviction of criminal offences provided for by the Uniform Acts before determining of the related penalties by national legislation: cases of misuse of corporate assets;
  • Coasting: professional brainstorming on an essential tool for the development of maritime fleets specific to CEMAC States.

Case Law:

  • CCJA case law on immunity from enforcement.

The ERSUMA Review is available in both hard and digital formats. It can be purchased as single order or by annual subscription.

Other sales contacts will be established in the States.

The annual subscription for the ERSUMA Review is CFA 17,000 regarding to the two (02) releases per year.
