ERSUMA - OHADA / Publication of Number 14 of the ERSUMA Bulletin of Professional Practice (BEPP)
The Regional High School of Magistracy (ERSUMA) of the Organization for the Harmonization of Business Law in Africa (OHADA) hereby notifies you the publication of its 14th release of the ERSUMA Bulletin of Professional Practice (BEPP).
This periodical informs you about the latest developments in business law, whether it is OHADA Law, the National Law of the Member States, other African Community Laws and Comparative Law.
In this release, through the sections on chronicles, case law, national legislation and professional practice, the reader will be able to obtain brief information on topics such as:
- Protection of third parties in the event of Commercial Companies' winding up : the contributions of article 201 of the UACC-EIG;
- The Transfer in lieu of payment subject to a condition precedent is not a real security within the meaning of the Uniform Act organizing security interests;
- The secured creditor must pursue his claim on the property specially allocated to guarantee its recovery before seizing the debtor's tangible or intangible movable property;
