The African Centre for Law and Development (CADEV) is pleased and honoured to inform you that it is organising the 2nd African Congress of Business Lawyers (« COJA 2009 ») from the 23rd to 25th June 2009, at Hotel Akwa Palace in Douala.
The topic of the conference is « Investment law in Africa, analysis in the context of OHADA law and sectoral regulations ».
The purpose of the conference is to engage in a critical and constructive debate on the relevance and effectiveness of the legal framework for investments in Africa. This discussion is particularly timely as new legal instruments, including in particular under the auspices of OHADA, are being adopted throughout the continent.
The topics for discussion include:
- A thorough analysis of OHADA. More than a decade has elapsed since the OHADA Uniform Acts entered into force, and since the establishment of the OHADA supranational court; thus it is now time to evaluate the true, practical impacts of the law. Practitioners and other legal professionals who work with the OHADA laws daily will report on their experience with the law, and specifically on its success in providing legal and judicial security.
- Analysis of techniques whereby OHADA countries could implement significant investment efforts by engaging the financial capacity and expertise of private actors. Legal problems relating to the redeployment of "the State as Manager" include B.O.T. "build, operate, transfer" arrangements, concessions, rural leases leasing, government contracts, etc...
Consideration of sectoral regulations (bank, mining, energy, telecoms, etc...) in order to evaluate their adequacy in the context of the sectors' needs and constraints.
In summary, the upcoming COJA 2009 will be a new opportunity for African lawyers to celebrate together the success of law as an instrument of integration and development in Africa.
