En vertu de l'article 279, le Code CIMA est d'application immédiate à tous les accidents survenus antérieurement à son entrée en vigueur qui n'ont pas donné lieu à une décision judiciaire passée en force de chose jugée ou à une transaction passée entre les parties. Il s'applique donc à un accident survenu en 1984.
Aucune transaction n'étant intervenue entre les parties, il convient de casser l'arrêt de la Cour d'appel qui condamne l'assureur à payer aux ayants droit de la victime décédée des dommages-intérêts.
