Contrat D'assurance - Code Cima - Vente Du Véhicule Assuré - Suspension Du Contrat D'assurance à Partir Du Transfert De Propriété Du Véhicule - Détermination Du Moment Du Transfert

Pour débouter les héritiers de la victime, mortellement blessée par un véhicule vendu à des tiers, de leur action en responsabilité dirigée contre ces derniers, les juges d'appel n'ont recherché ni la personne qui avait la maîtrise du véhicule au moment de l'accident, ni si la chose vendue avait bien été livrée, violant ainsi les dispositions des articles 137, 138, 264 et 276 du Code des Obligations Civiles et Commerciales.
