En déférant à la censure du Juge de première instance une décision rendue par la juridiction suprême, en l'occurrence la Cour suprême, le demandeur a violé les normes juridiques fixant la hiérarchie des juridictions. Dès lors l'appel du demandeur est non fondé en ce que l'ordonnance de référé rendue par la Cour suprême continuant de produire ses effets, constitue le titre exécutoire qui autorise la saisie-vente mobilière.
