Injonction De Payer - Créance Certaine Et Liquide - Preuve De La Certitude De La Créance - Facture Pro-forma, Unique Fondement De La Certitude De Créance (non)

Le créancier qui poursuit le recouvrement de sa créance par la procédure d'injonction de payer doit soumettre à la juridiction compétente une requête qui satisfait aux exigences de l'article 1er AUPSRVE. La certitude de la créance en fait partie. N'est pas certaine la créance fondée exclusivement sur une facture pro-forma, non soutenue par aucune preuve à même de permettre la caractérisation de la certitude de la créance.

En ordonnant une injonction de payer dans ces conditions, le Tribunal de Première instance a violé la loi.
