Droit Commercial Général - Bail Commercial - Défaut De Paiement Des Loyers - Action En Expulsion - Formalités Préalables - Non-respect - Absence De Préavis - Mise En Demeure Irrégulière - Application Du Code Civil (non) - Application De L'audcg (oui) - Action Recevable (non)

Faute de paiement des loyers par le locataire, le bailleur peut demander son expulsion devant la juridiction compétente. Préalablement à cette action, il doit mettre en demeure le locataire d'avoir à respecter les clauses et conditions du bail et respecter un délai de préavis de six (06) mois conformément à l'AUDCG applicable en l'espèce. Le non-respect de ces formalités préalables est sanctionné par l'irrecevabilité de l'action en expulsion.
